10. A Beneficiary must nominate to the Trustees in writing, at the time he is admitted to the Fund, a person or persons to whom the monies accumulated for his benefit are to be paid in case of his death, and he shall have the right to change the nominee by giving notice in writing to the Trustees.

In the event of such person or persons having died, and the Beneficiary having also died without appointing a substitute nominee, or in the event of such person or persons having become insane or their whereabouts being unknown, the monies accumulated will be paid to the Ben- eficiary's legal successor.

In the case of death before the completion of ten year's service after the date of admission to the Fund, one tenth of a year's pay for each year of completed service since the date of the last contribution by the Company will be added to the amount standing to the credit of a Ben- eficiary in the books of the Fund and the total will be paid by the Trustees to the person or persons nominated by the Beneficiary or his legal successor as hereinbefore provided, and in all cases the decision of the Trustees shall be final and binding

11. The Fund can be dissolved at any time at the discretion of the Trustees. In such case all sums standing to the credit of the Ben- eficiaries shall be paid to them subject to the provisions of these rules.

12. These rules are printed in English and the English version shall be the only authoritative and binding text any other version prepared being a translation only, for the information of Beneficiaries,

13. Any point not covered by the above regulations or any question arising as to the interpretation thereof shall be decided by the Employers and Trustees conjointly at their entire discretion.

Provided that the object of the Fund (namely the provision of Long service gratuities for native members of the Employers' Chinese and/or Japanese staffs) is not thereby affected, the Trustees may from time to time in their discretion with the concurrence of the Employers, add to, repeal or alter all or any of these rules.
